This prosecution would fail for lack of jurisdiction. The alleged crime must be committed within the boundaries of the state. If you are referring to deaths that occurred overseas, then international law and federal law apply. Both international law and federal law are clear, the sovereign is immune from prosecution.
Imagine a fire marshal in California ordering volunteers to put out a fire, only to see them perish. Under your attorney general’s rationale, the fire marshal could be tried for murder by the states that the service men came from, or worse, all 50 states could attempt to prosecute the fire marshal. In this case, shouldn’t California deal with the issue?
It is a bit disturbing that your Attorney General follows neither the law, nor the Constitution. How can he be any better than a president with his own violations? Your attorney general and George Bush seem no different to me, the law should apply to everyone.

Sure, as long as Congress who approved and funds the war is prosecuted too (Bush couldnt just do it, despite what the haters say), and dont give us that weak argument that they didnt have the same intel GWB did.

The Iraq War was in violation of The Geneva Convention. George Bush is asking Congress to pass a law granting him immunity from prosecution.
